Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Hey Cameraman mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Taylor Simmons ("Developer," "we," "our," or "us").

2. Description of the App

Hey Cameraman is a voice and hand gesture controlled camera application for iOS that allows users to capture photos, record videos, and control camera settings using spoken voice commands or simple hand gestures. The App uses on-device speech and vision recognition to interpret commands and control the device camera.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) for your personal, non-commercial use, in accordance with Apple's Licensed Application End User License Agreement (EULA).

You may NOT:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful, harmful, or unauthorized purpose
  • Remove or alter any proprietary notices in the App
  • Use the App to develop a competing product

5. In-App Purchases & Subscriptions

A) Free Tier:

The App is free to download and use. The free tier includes access to core camera features. Certain advanced features have limited free uses or require a Pro upgrade.

B) Hey Cameraman Pro:

The App offers "Pro" features which can be unlocked through two types of purchases:

  • Monthly Subscription: Unlocks all Pro features while the subscription remains active.
  • Lifetime Purchase: Unlocks all Pro features with a single, one-time payment.

C) Payment & Billing:

  • Payment will be charged to your Apple ID account at purchase confirmation.
  • Auto-Renewal: For monthly subscriptions, the subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

D) Refunds:

All transactions are handled by Apple through the App Store. We do not handle refunds directly. Refunds are processed and managed by Apple. To request a refund, please contact Apple Support directly at reportaproblem.apple.com.

E) Restore Purchases:

If you have previously purchased a Lifetime license or have an active subscription, you can restore your access at no additional cost by tapping "Restore Purchase" on the upgrade screen. This is useful when reinstalling the App or switching devices.

6. User Content

You retain full ownership of all photos and videos you capture using the App. We do not claim any rights to your content. All media is saved directly to your device's Photo Library and is not uploaded to or stored on any external server.

You are solely responsible for the content you create using the App. You agree not to use the App to capture or distribute content that:

  • Is unlawful, harmful, threatening, abusive, or harassing
  • Violates any person's privacy or publicity rights
  • Infringes any intellectual property rights
  • Contains illegal material

7. Device Permissions

The App requires access to your device's camera, microphone, speech recognition, and photo library to function. You may grant or deny these permissions at any time through your device's Settings. Denying required permissions may limit or prevent the use of certain App features.

The App uses these permissions solely for the purposes described in our Privacy Policy and does not access these systems for any other purpose.

8. Recognition Technology

A) Speech Recognition:

The App uses Apple's Speech Recognition framework to process voice commands. By using the voice command features, you acknowledge that:

  • Speech recognition accuracy may vary depending on environmental conditions, accent, pronunciation, and device hardware.
  • The App processes speech on-device when supported. On older devices, iOS may use Apple's servers for speech processing, subject to Apple's own privacy policy.
  • The App is not responsible for misinterpreted commands or unintended actions resulting from speech recognition errors.

B) Hand Gesture Recognition:

The App uses Apple's Vision framework to detect and interpret hand gestures. By using gesture controls, you acknowledge that:

  • Gesture recognition requires adequate lighting and a clear view of the user's hand within the camera frame.
  • Recognition accuracy may vary based on distance, hand orientation, and background complexity.
  • All gesture processing is performed in real-time on-device. No video data used for gesture recognition is recorded or stored by the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, timely, secure, or error-free
  • Voice commands will be recognized with 100% accuracy
  • The App will be compatible with all devices or iOS versions
  • Defects will be corrected
  • The results obtained from using the App will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PHOTOS OR VIDEOS, LOSS OF PROFITS, OR DAMAGE TO YOUR DEVICE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Content you create using the App

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease. You may terminate your use of the App at any time by deleting it from your device.

Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Intellectual Property

The App, including its design, code, graphics, user interface, and all related intellectual property, is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws. "Hey Cameraman" is a trademark of the Developer.

Nothing in these Terms grants you any right to use the Developer's trademarks, logos, or branding.

14. Third-Party Services

The App uses Apple's frameworks and services (AVFoundation, Speech, Photos, StoreKit). Your use of these services is subject to Apple's terms and conditions. We are not responsible for the availability, accuracy, or performance of Apple's services.

The App may contain a link to open the Apple Photos app. We are not responsible for the content or functionality of third-party applications.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Apple's Licensed Application End User License Agreement (EULA), constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements and understandings.
